State Council Issues New IPR Promotion Plan
After deliberation at the third plenum of the State Council's inter-ministry joint meeting on the implementation of IPR strategy, China's new IPR work plan, the 2018 Promotion Plan for Further Implementing National IPR Strategy and Accelerating IPR Development, was recently passed and released. The Promotion Plan laid down 6 key tasks, including 15 key sections containing 109 concrete measures.
In terms of deepening IPR sector reform, the plan calls for efforts to 1) Explore a state-level IPR case-related appeal and trial mechanism; 2) Explore a model for enabling the Beijing-based IPR court to hear tech-focused IPR cases occurring across the Beijing-Tianjin-Hebei region; 3) Study the introduction of a "three-in-one" trial mechanism (i.e. allowing IPR-related civil, administrative and criminal cases to all be heard by IPR courts); and 4) Establish new IPR tribunals in four cities, including Xi'an and Zhengzhou. This work will be in the charge of the Supreme People's Procuratorate (SPP).
