Revisions for FIE-Related Laws Approved
On September 3, the National People's Congress passed revision drafts on four Foreign Investment Enterprise related laws. The Ministry of Commerce (MOFCOM) submitted the drafts separate from revisions of the combined (three in one) Foreign Investment Law. After 3 years of trial implementations in the Shanghai Free Trade Zone, this revision will establish a legal negative list system that will be implemented nationwide. The revised laws will take effect on October 1, 2016
As an important implementation measure, MOFCOM released revised Interim Administrative Measures for Registration of the Establishment of and Changes to Foreign-Invested Enterprises (Draft for comments) which is open for comments until September 22. These measures are also set to go into effect on October 1, 2016.
