SAIC Focuses on Consumer Rights
On August 5, the State Administration of Industry and Commerce (SAIC) released the Regulations on Implementation of the P. R. C. Law on Protection of Consumer Rights and Interests. The current draft is open for comments through September 5. According to the announcement, the regulation is scheduled to go into effect at the end of 2016.
The main areas of concern for the ICT community include:
Article 7: Establish a recall system for defective products or services
Article 8: Product compliance requirements that meet mandatory standards and industry standards in human and property safety
Article 9: Operators who provide free products or services should comply with mandatory standards.
Article 19: Online transaction platforms are liable for checking dealer IDs
Article 22: Operator requirements for personal information collection and use
Article 38: Use an Online management system to ensure transaction security and assess credit assessment. Also create a consumer information security assurance system
Article 63: Punishment for violating Article 38
