PRC Radio Regulation Draft Law Released
According to a MIIT news release, on September 1 the State Council passed the People's Republic of China Radio Regulation (Draft Law) . This is the second important development regarding radio management, and follows closely behind MIIT's release of the National Radio Management Plan (2016-2020).
This regulation will be jointly published by the State Council and the Central Military Commission, however the full text has not yet been released. The original Radio Regulation was released in 1993 to promote the development and use of radio frequency and to maintain order in airspace. With recent developments and the broad application of radio technology, MIIT and the PLA decided to make amendments to this regulation.
The amended draft improves policies on radio frequency development and use, station management, device management, monitoring and maintaing airspace order, and legal responsibilities to name a few. Additionally, it reduces administrative approval and increases penalties for criminal activities such as establishing fake base stations and illegal broadcasting.
The news release emphasizes that the draft law will provide a strong legal framework in promoting the effective development and use of radio frequency, safeguarding radio management work and promoting the healthy development of radio management.
