Chinese Think Tank Responds to WTO Filling on Cybersecurity Law
On October 24, Legal Weekly, a specialized legal media outlet, published a response to the US Government’s WTO filing on China’s Cybersecurity Law (CSL) written by an expert from CAICT, a think tank under the Ministry of Industry and Information Technology (MIIT) with expertise and influence in telecom and Internet policy.
The highlights of the response include:
- Disagreement on China’s data flow measures originate from different perspectives - while the U.S. focuses on free flow of data, China focuses on "law-based and orderly" data flow.
- A broad definition of "network operators" is necessary as network owners, administrators and service providers should all assume responsibility for safeguarding cybersecurity.
