Discussion with Dr. Ling Dong and Tingting Liu on SAIC Rules of Prohibition of Abuses of IPR for Eliminating or Restricting Competition

Please join USITO for a members only discussion with Dr. Ling DONG, Executive Director of Competition Law Center of UIBE and Tingting LIU, Associate from WilmerHale, on of the Rules of the Administration for Industry and Commerce on the Prohibition of Abuses of Intellectual Property Rights for the Purposes of Eliminating or Restricting Competition (in Chinese:《工商行政管理机关禁止滥用知识产权排除、限制竞争行为的规定》), that SAIC released for public comment through early July  on Tuesday, June 24th.

 

Dr. Dong, who has been working closely with SAIC in the Rules drafting processes from the very beginning, will share his understandings on the background, targets, and key articles that SAIC might still not certain. Ms. liu will mainly touch on how the Rules, if enacted in their current form, would curtain IPR, and how this approach would put China at odds with current practices in major antitrust-enforcement jurisdictions around the world.

Speakers:

Ling DONG is Associate Professor of Law, Law School of University of International Business & Economics (UIBE) and Executive Director of Competition Law Center of UIBE. He has been teaching in the Law School of UIBE since August 1995, with major research focuses on Competition Law and Civil Law. He is the co-founder of the Competition Law Center of UIBE.  He published “Critical analysis of selected antitrust law cases” (with Prof. Huang Yong) and the same series “Critical analysis of Leading antitrust law cases----Anti-competitive Agreements” (with Prof. Huang Yong) by the People’s Court Press. His papers and articles in Competition Law have been published in various academic periodicals, such as “On IPR-related monopolization prohibition system”( Electronics intellectual property) and “On illegal price monopolistic agreements on antimonopoly law of China”(Price: Theory & Practice),etc.  Ling holds a Masters Degree of Law from South-west Law University (China), LL.M from University of Connecticut (U.S) and Doctor of Law from UIBE.

Tingting Liu advises clients on foreign direct investment, foreign trade, mergers and acquisitions, joint ventures, financial services, pre-litigation analysis and other general corporate matters. She also advises governments and corporations on anti-monopoly law issues and FCPA compliance. 

Ms. Liu received her LLM degrees from the University of Pennsylvania School of Law and the University of Hong Kong. She received her LLB degree from East China University of Political Science and Law with honors. She is a member of the New York State Bar Association. 

Prior to joining WilmerHale, Ms. Liu worked in Simpson Thacher & Bartlett LLP’s Beijing office focusing on US capital markets. She also worked in Milbank Tweed Hadley & McCloy LLP’s Hong Kong office on capital markets and project finance. 

Ms. Liu is fluent in English and a native Mandarin speaker.
