MOF Releases Additional Measures on Government Procurement

On February 13, the Ministry of Finance (MOF) released Government Procurement Suppliers Questioning and Complaints Handling Measures (Draft for Comment), with a deadline of Mar. 10. These draft measures are put in place to further implement the Government Procurement Law and protect supplier's rights. It lists the process for questioning and filing complaints in great detail and also clarifies government agency response times and responsibilities.
Some highlights from the Draft include:

  • questioning process precedes filing complains
  • suppliers must file in a transparent manner, supplying identification and supporting documents
  • questions regarding a procurement process has to be be filed together in paper
