GAC Issues New Customs Inspection Measures

On September 26, the General Administration of Customs (GAC) issued the Implementing Measures for the Regulations of the People's Republic of China on Customs Inspections, which will go into effect on November 1, 2016.

Main takeaways of the Measures include the following:

  1. Establishing a Proactive Disclosure System
    • Details for a proactive disclosure system of enterprises, to specify the identification criteria implementation procedures and legal liability in respect of the proactive disclosure, and enhance the operability and effectiveness of the proactive disclosure system.
  2. Entrusting Professional Institutions
    • Relevant provisions on entrusting professional institutions are refined to clarify the scope of professional institutions that can be entrusted by the customs, entrusting ways and legal consequences etc., resolve specific operational issues, and improve the efficiency of the customs to entrust social powers to assist management;
  3. Inspection Procedures Clarified
    • Including the inspection jurisdictions, administration of enforcement qualification of inspectors, termination of inspection procedures, confirmation of and signing for inspection documents are further stipulated, and rights and obligations of all parties are also straightened out.
